CAUSE OF INJURY: Medical Malpractice/Overdose of Phenergan. On April 4, 2001, in Oxford, Plaintiff James presented to his physician with a sinus infection. Upon examination, James was diagnosed with dehydration and administered IV fluids. Plaintiffs alleged that James was also administered a 250 mg dose of Phenergan instead of 25 mg dose (a medical assistant misread the bottle). James lost consciousness within seconds and cannot recall any events for approximately ten to twelve hours. James experienced several apneic episodes and was immediately taken to the emergency room at Anniston Regional Hospital for overnight monitoring. Since his recovery and discharge, James claimed that he continued to experience poor concentration and memory problems.
NATURE OF INJURY: Severe headaches; memory loss; emotional distress; mental anguish; permanent injury; medical expenses.
